Nursing home residents have the legal right to be free from abuse and neglect. Unfortunately, too many of our country's eldest and most vulnerable citizens are being abused and neglected.  Far too often these frail and dependent citizens are victims of physical, sexual, and emotional abuse and neglect while residing in a nursing home, assisted living facility or other long-term care institution.

Nursing home abuse takes many different forms, but the most common forms of abuse are:

  • Neglect - Failure to meet the resident’s basic care needs
  • Physical Abuse - Use of force against a nursing home resident
  • Emotional Abuse - Someone produces emotional or psychological distress to a nursing home resident
  • Sexual Abuse - Someone has any type of sexual contact with a nursing home resident

Signs and Symptoms of Nursing Home Abuse and Neglect

How do you know whether a nursing home resident is being abused or has been abused or neglected?  Unfortunately, many people do not recognize when a loved one is being victimized because many of the signs and symptoms of nursing home abuse and neglect can mimic symptoms of physical or mental deterioration and dementia. The consequences of abuse and neglect can be tragic. Laws vary from state to state, but every state has a statute of limitations that requires you to take action within a certain amount of time.

Federal Regulations

Pursuant to Federal law, institutions must meet certain requirements in order to qualify to participate as a Skilled Nursing Facility in the Medicare program and as a nursing facility in the Medicaid program. We refer to these requirements as the Federal Regulations.
